KinShip Cup™ — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the KinShip Cup™ website, apps, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.
1) What KinShip Cup is
KinShip Cup is an entertainment platform that helps groups run private fantasy-style leagues based on selecting teams, tracking results, and sharing league updates. The Service provides tools for league creation, invitations, scoring displays, standings, and related features.
2) Not a betting service; no money handling
KinShip Cup is not a betting or wagering service. We do not host, accept, manage, hold, or distribute entry fees, wagers, or prize money. If your league chooses to run an optional prize pool, that arrangement is between league participants and is typically handled by the league commissioner or members outside of KinShip Cup. You are responsible for ensuring any prize pool or similar arrangement complies with applicable laws.
3) Eligibility
You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you represent that you have permission from a parent or legal guardian to use the Service. We may suspend or terminate accounts we reasonably believe are used by someone under 13.
4) Accounts and security
You may need an account to use certain features. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account. To help enforce eligibility and run the Service, we may ask for your birth year and a self-reported sex selection (Male, Female, or Prefer not to say).
5) League roles; commissioner authority
Leagues are created and managed by a “Commissioner” (or similar role). Commissioners may control league settings, invitations, and certain league features. You understand that commissioners may:
- Invite and remove participants,
- Adjust certain league settings (as permitted by the Service),
- Control certain communication features for the league.
KinShip Cup is not responsible for commissioner decisions or league disputes.
6) Your content and conduct
You are responsible for content you submit through the Service (for example: display names, chat messages, comments, or optional profile details). You agree not to:
- Harass, threaten, or bully others,
- Post unlawful, deceptive, or defamatory content,
- Attempt to access accounts or data that aren’t yours,
- Interfere with the Service (e.g., scraping, automated abuse, or introducing malware),
- Use the Service to violate any laws or third-party rights.
We may remove content or restrict accounts that violate these Terms.
7) Communications
The Service may send you transactional messages related to your account and leagues (such as invites, confirmations, reminders, or recap emails). You may be able to adjust certain notification settings, but some messages are necessary to operate the Service.
8) Data, standings, and accuracy disclaimer
Standings, results, and historical data displayed in the Service may be derived from third-party sources and/or automated processes and may update over time. We aim for accuracy, but we do not guarantee that standings, results, or historical displays are complete, current, or error-free.
9) Intellectual property
The Service (including its design, code, features, and branding) is owned by KinShip Cup and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer the Service except as allowed by law. KinShip Cup™ and related logos are trademarks of KinShip Cup. Team names, league names, and other third-party marks may be the property of their respective owners. KinShip Cup is not affiliated with or endorsed by any league or team unless explicitly stated.
10) Service availability; changes
We may change, suspend, or discontinue any part of the Service at any time, including features, pricing, or availability. We may also update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
11) Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service if we believe you violated these Terms, created risk, or misused the Service.
12) Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
13) Limitation of liability
To the fullest extent permitted by law, KinShip Cup will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other losses arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the claim (or $100 if you paid nothing), unless applicable law requires otherwise.
14) Governing law
These Terms are governed by the laws of the jurisdiction where KinShip Cup is organized, without regard to conflict of law principles.
